Consultancy Terms and Conditions

In these consultancy terms and conditions, we are Milk and Money Ltd, a limited liability company registered in England and Wales under company number 16025795 and have our registered office at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ (Milk&Money, we, us, our). Milk&Money operates the website milkandmoney.co.uk (Website).

You are an individual who has chosen to purchase consultancy services from Milk&Money in relation to optimising childcare funding options (the Services), subject to these consultancy terms and conditions.

1. You accept these terms

1.1 By agreeing to purchase the Services, you confirm that you accept these consultancy terms and conditions and that you agree to comply with them.

1.2 If you do not agree to these consultancy terms and conditions, you must not purchase the Services.

1.3 We recommend that you print a copy of these terms for future reference.

3.1 You may only purchase the Services if you are aged 18 years or over.

3.2 In agreeing to purchase the Services, you confirm that you are eligible to do so and that you understand the limited scope of the Services provided (as described in section 2).

4. Provision of the Services

4.1 In consideration of the Charges (as defined in section 5), Milk&Money shall provide you with the Services with all reasonable skill and care.

4.2 All consultations are subject to availability and are scheduled on a first-come, first-served basis. You are required to book your consultation with Milk&Money using our online calendar tool, available through the Website. Please note that all appointment requests are subject to manual review and confirmation by Milk&Money; your selected time slot is not guaranteed at the time of booking. Upon completion of your online booking, Milk&Money will use reasonable endeavours to ensure the availability of your selected time slot. You will receive an email confirmation from Milk&Money once your booking has been processed and your consultation is confirmed. While we make every effort to ensure the time slot you have selected is available, Milk&Money reserves the right to reschedule consultations if necessary. Should a rescheduling be required, we will notify you as soon as reasonably practicable and offer alternative consultation options. For the avoidance of doubt, your consultation is not confirmed until you have received our email confirmation following manual review.

4.3 All consultation times and dates will be as confirmed in your email confirmation. It is your responsibility to ensure you are available at the booked time. If you are late to a consultation, Milk&Money is not obliged to extend the duration of the session beyond the scheduled end time.

4.4 As part of the Charges, provided always that you comply with these consultancy terms (and in particular section 12.3), Milk&Money agrees to provide you with a Premium subscription to the Website at no additional cost for 12 months (Subscription Services), provided that your consultation has actually taken place. In this regard, the following additional terms and conditions shall apply to you:

5.1 The charges for the Services will be clearly displayed during the checkout process (the Charges).

5.2 We charge you for the Charges at the point that you order the Services from us using the Website.

6. Cancellation of consultations

6.1 The provisions of this section shall always be subject to your legal right to change your mind, as further detailed in section 9.1.

6.2 Should you need to amend or cancel your booking, please provide as much notice as possible and contact us at support@milkandmoney.co.uk.

6.3 Once a consultation has been confirmed, the following cancellation policy shall apply:

6.4 The above policy also applies to rescheduling requests, unless we waive fees due to extenuating circumstances.

6.5 Notice periods are calculated in calendar days and hours from the scheduled consultation start time.

6.6 If you fail to attend a scheduled consultation without providing notice (“no show”), the full fee will be payable and no refund issued.

6.7 If you receive a refund but do not attend a rescheduled consultation, you will lose eligibility for Subscription Services.

7. Delay

7.1 If our supply of the Services is delayed by an event outside our control, we will contact you as soon as possible to let you know and do what we can to reduce the delay. As long as we do this, we won’t compensate you for the delay, but if the delay is likely to be substantial you can contact us to end the contract and receive a refund for any Services you have paid for in advance but not received.

8. Information required from you

8.1 We are reliant on you providing us with the necessary information in order for us to provide the Services to you. We accept no responsibility and disclaim all liability in the event that you do not give us the information we’ve asked for or the information you do provide us is incorrect, incomplete or misleading.

10.1 We do not exclude or limit our liability where it would be unlawful to do so (e.g., for death or personal injury caused by negligence or fraud).

12. Intellectual property rights

12.1 All intellectual property rights in or arising out of or in connection with the Services (other than materials provided by you) belong to us.

12.2 We grant you a fully paid-up, worldwide, non-exclusive, royalty-free, perpetual licence to use the Deliverables for personal, non-commercial purposes.

12.3 The rights in 12.2 are personal to you and cannot be sub-licensed or transferred.

12.4 You grant us a licence to copy and modify any materials you provide for the purpose of delivering the Services.

13. Data protection

Personal data supplied by you will only be processed as set out in Milk&Money’s Privacy Policy.

14.1 We reserve the right to hold void, cancel, suspend, or amend services if necessary or if you breach these terms.

14.2 We can transfer our contract with you to another organisation. You can contact us to end the contract if you are unhappy with this.

14.3 You cannot transfer your rights under these terms to anyone else.

14.4 No person other than the named purchaser of Services has any rights under these terms.

14.5 If a court invalidates some terms, the rest will continue to apply.

14.6 Even if we delay enforcing rights, we can still enforce them later.

14.7 If our Services are delayed by an event outside our control, we will notify you and do our best to reduce the delay.

14.8 These terms are governed by English law. You can bring claims against us in the English courts, or in the courts of Wales, Scotland or Northern Ireland if you live there.
